Welcome to FlashFuel. By accessing or using our mobile fuel delivery service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, placing an order, or using any FlashFuel service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.

2. Service Description

FlashFuel provides on-demand and scheduled fuel delivery services to vehicles at customer-specified locations. Our services include:

• Premium gasoline (91 octane) delivery
• Regular gasoline (87 octane) delivery
• Plus gasoline (89 octane) delivery
• Diesel fuel delivery
• Scheduled and recurring delivery options
• Fleet fueling services

3. Eligibility

To use FlashFuel services, you must:

• Be at least 18 years of age
• Have a valid driver's license
• Own or have authorization to fuel the vehicle
• Provide accurate account information
• Have a valid payment method on file

4. Account Registration

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and up-to-date

5. Orders and Pricing

5.1 Placing Orders

Orders can be placed through our mobile app or website. By placing an order, you are making an offer to purchase fuel delivery services at the stated price.

5.2 Pricing

• Fuel prices are based on current market rates plus our service margin
• A delivery fee of $9.99 applies to all orders (may vary by location or time)
• Prices are subject to change without notice
• Dynamic pricing may apply during peak demand periods
• Discounts may be available for off-peak delivery windows

5.3 Order Confirmation

We reserve the right to refuse or cancel any order for any reason, including but not limited to:

• Unavailability of fuel or drivers
• Pricing or product description errors
• Suspected fraudulent or unauthorized transactions
• Unsafe delivery locations or conditions

6. Payment Terms

6.1 Payment Methods

We accept major credit cards, debit cards, and other payment methods as displayed in the app. You authorize us to charge your payment method for all fees incurred.

6.2 Billing

• Payment is processed at the time of order placement
• For recurring orders, you authorize automatic billing
• You are responsible for all charges, including applicable taxes

6.3 Refunds

Refunds may be issued at our discretion for:

• Service failures or delivery errors
• Cancelled orders (before driver dispatch)
• Quality issues with delivered fuel

7. Delivery Terms

7.1 Delivery Requirements

You must ensure:

• Vehicle is accessible and unlocked at scheduled time
• Delivery location is safe and legal for fueling operations
• No ignition sources are present within 25 feet
• Compliance with all local fire codes and regulations

7.2 Delivery Windows

Scheduled deliveries are estimated arrival windows, not guaranteed times. Delays may occur due to traffic, weather, or other factors beyond our control.

7.3 Access Requirements

If our driver cannot safely access your vehicle or complete the delivery, you may be charged a failed delivery fee.

8. Safety and Compliance

Our drivers follow comprehensive safety protocols, including:

• Pre-delivery safety checklists
• Proper grounding and bonding procedures
• Spill prevention and response measures
• Fire extinguisher availability
• Photo documentation of delivery

9. Prohibited Uses

You may not:

• Use our services for any illegal purpose
• Request delivery to unsafe or prohibited locations
• Interfere with or disrupt our services
• Attempt to defraud or abuse our services
• Resell fuel delivered by FlashFuel
• Harass or abuse our drivers or staff

10. Rewards Program

FlashFuel Rewards points:

• Have no cash value
• Cannot be transferred or sold
• May expire according to program terms
• Can be redeemed only through the FlashFuel platform
• Program terms may change with notice

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• FlashFuel is not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount paid for the specific service
• We are not responsible for vehicle damage caused by pre-existing conditions
• We are not liable for delays caused by factors beyond our control

12. Indemnification

You agree to indemnify and hold FlashFuel harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of our services
• Your violation of any laws or third-party rights
• Providing false or misleading information

13. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or suspicious activity
• Abuse of our services or staff
• Non-payment of fees

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website or app. Continued use of our services constitutes acceptance of modified Terms.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Massachusetts.

16. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class actions.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

18. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and FlashFuel regarding our services.
